Any person from whom the garbage, rubbish or waste matter is collected under the provisions of this chapter shall pay the city, through the office of the city clerk, such fees and charges as the city council, by resolution, shall from time to time fix and set; provided further, that in the event that a contract is entered into pursuant to Section 8.04.040, the contractor shall collect the fees and charges unless otherwise provided by the contract and such fees and charges shall be paid to such contractor rather than to the city clerk.
